Atlanta Burglary Defense Lawyers

In Georgia, burglary is defined as the unlawful entering of a dwelling, vehicle, or other structure with the intent to commit a felony or theft. It is a serious crime that is punishable by imprisonment and fines.

Burglary is a felony charge, however some theft crimes in Georgia are misdemeanors and others felonies

If you or someone you know has been arrested due to a burglary or theft charge, or if you’ve faced charges in the past then you need to familiarize yourself with Georgia’s Burglary laws. As with any other criminal charge you should contact an experienced criminal defense attorney, like those at the Arora Law Firm.

Georgia’s Burglary Laws

First Degree Burglary

First-degree burglary is the most serious type of burglary and is punishable by up to 20 years of prison. It involves breaking and entering into a dwelling with the intent to commit a felony or theft.

Second Degree Burglary

Second-degree burglary is a less serious crime and is punishable by a minimum of one year in prison and a maximum 5 years of prison. It involves entering a vehicle or other structure without consent with the intent to commit a felony or theft. Essentially, if a building is ‘dwelling’ then it is first-degree.

What is a 'dwelling?'

Per GA code 16-7-1 a dwelling ‘means any building, structure, or portion thereof which is designed or intended for occupancy for residential use.’
